Instagram Giveaway Terms & Conditions

  • For the purposes of these Terms and Conditions, “The Promoter” refers to NMG Network whose Instagram handle is @nmgnetwork. The “Prize” refers to 4 Photocon Hawaiʻi General Admission free passes. 
  • This competition is subject to federal, state, and local laws and regulations.
  • By entering the competition you agree to be bound by these terms and conditions. All entries must be received by 11:59AM HST Thursday February 22, 2024. Four (4)  winners in Honolulu will be selected at random by The Promoter on Friday 23, 2024 and the winner will be notified on or after this date
  • The Promoter’s competition with entry via Instagram is open only to residents of the United States. Four (4) winners will be chosen at random from all entrants and across the platform.
  • No purchase necessary. Winners will not be required to pay to enter the competition.
  • Entrants must be over 18 years old on the date of their entry.
  • Employees of The Promoter and other companies associated with the promotion of the competition, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.
  • Instagram or Facebook are not in any way affiliated or involved in the competition.
  • Only one entry per person per competition will be accepted.
  • Each entrant shall enter the competition via Instagram by:
    • Liking the giveaway post by @nmgnetwork.
    • Tagging another user in the comments section of the giveaway post by @nmgnetwork.
    • Re-sharing one of the three images by @nmgnetwork on the entrant’s IG Stories.
  • The Prize will be awarded to a randomly selected winner who has entered on Instagram, using a random number generator. The Promoter will not be held liable if the named prize becomes unavailable or cannot be fulfilled.
  • The Promoter will not be held liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.
  • To the extent permitted by applicable law, The Promoter’s liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question.
  • To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
  • By participating in the Contest, entrants agree to release and hold harmless the Promoter, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the competition, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the competition or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the competition; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the competition, including, without limitation, errors that may occur in the administration of the competition, the announcement of the winner, the cancellation or postponement of the event, if applicable, the incorrect downloading of the application the processing of entries application downloadsor in any competition-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the competition or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the parties’ liability will be limited to the cost of entering and participating in the competition, and in no event shall the entrant be entitled to receive attorneys fees. The parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
  • Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the promoter reserves the right to substitute that prize for a prize of equal or higher value.
  • The name, address, email address and phone number of the winner must be provided to The Promoter if requested and will be shared to enable fulfillment of the Prize.​
  • In the event of unforeseen circumstances beyond The Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
  • The Promoter’s decision is final. No correspondence will be entered into.
  • The winner’s name and social media username may be posted on the social media profiles of The Promoter after the winner has been selected.
